4.The grounds for complaint :
a) PIO deny to the give any Information with wrong arguments, Its violation of RTI Act-2005.
b) Required information as per the bullet points in my RTI Application not received from the CPIO.
मैंने सूचना के अधिकार अधिनियम-2005 के तहत जामिया मिल्लिया इस्लामिया के जन सूचना अधिकारी को दिनांक 22.10.2011 को तीन अलग-अलग आवेदन दिया था। (तीनों आवेदनों की प्रतिलिपी संलग्न) आवेदन देने के बाद मुझसे दिनांक 29.11.2011 को जो सूचना प्राप्त हुई, वो आवेदक के साथ एक बेहुदा मज़ाक था। (प्रतिलिपी संलग्न) जामिया ने अपने इस पत्र में सूचना देने से बचने के लिए कानून के गलत धाराओं का हवाला दिया गया है, जो किसी भी रूप में मेरे द्वारा पूछे गए प्रश्नों पर लागू नहीं होता। इस प्रकार देश के नागरिक होने के नाते मेरे अधिकारों की अनदेखी हुई है। सूचना का अधिकार क़ानून की अवहेलना हुई है और देश के इतने बड़े शैक्षणिक संस्थान की गरिमा भी कलंकित हुई है।
अत: इस संदर्भ में श्रीमान से यह निवेदन है कि सूचना के अधिकार अधिनियम की धारा-18 के तहत इस विषय पर सुनवाई करते हुए जन सूचना अधिकारी को तुरंत सूचना उपलब्ध कराने का आदेश दें। साथ ही, सूचना के अधिकार अधिनियम के उल्लंघन के लिए जन सूचना अधिकारी पर अधिनियम के प्रावधानों के अनुसार जुर्माना भरने का आदेश दें।
मैं आशा करता हूं कि मेरे इस शिकायत पत्र को गंभीरता से लेते हुए इस दिशा में तत्काल कार्यवाही की जाएगी ताकि मुझे जानकारी मिल सके और सूचना कानून में नागरिकों (छात्रों) को दिए गए अधिकारों का मान व मर्यादा बनी रह सके।
आपसे न्याय की अपेक्षा सहित,
5.Prayers:
a) ENQUIRY: Sir, exercising powers of Civil Court vested in you under section 18, please enquire into this Complaint.
b) DIRECTIONS TO PIO: Sir, please direct PIO to comply with requirements of Sec 7(1) and give proper reply to RTI Application.
c) PENALTY: Sir, please impose penalty as per Section 20 as the PIO, “without any reasonable cause, refused to receive an application for information or has not furnished information within the time specified under section of RTI Act-2005 ”.
d) DISCIPLINARY ACTION: Sir, please recommend disciplinary action against PIO as per Section 20(2), who has, “without reasonable cause and persistently” denied my request for information.
e) The CPIO be penalized and strict disciplinary action be taken against him under services conduct Rules and Discipline and Appeal rules 1968 and 1969.
a) If any information is denied then please quote the exemption clause of Section 8 (1) and a brief reason as to how it applies. This is a requirement of the RTI Act, as per Section 7 (8) (i) read along with Section 19 (5).
